i purchased two mobile phones, a nokia 2310 and a nokia n-73 phone both on 30/ 12/ 2006, from a mahavir-nx, thane, an authorised nokia shop and have the bill and the warranty card. the 2310 phone which has the bl-5c battery (serial number-0670400462040N475G10425198)was heating up like the other n-73 while charging. 

we visited the gallery and were explained the heating of the battery was normal. recently i observed that the back-casing of the 2310 has broken from one side and the battery seems swollen up. this afternoon we approached the nokia care center in thane, near the civil hospital.

they advised us that the battery is not from the defective lot battery and so is not entitled for a free replacement. he also advised that the swelling of the battery could be result of overcharging. the phone was working alright and i never dropped it down. 

they advised us that there was no stock of the bl-5c battery and the sane could be purchasd from any nokia-priority shop. we visited the kasam bros nokia shop, ram maruti road, thane. they sold us the new bl-5c battery and a new case. recently, i purchased another e-51 nokia handphone, which also heats up while charging and even while talking. 

now i have many questions
1) will it happen again.
2) is it safe to use these phones. 
3) is it safe to use the 2310, n-73 or the e-51 phones, which also heat up during charging.
4) who will pay for the defective and dangerous products sold to us.

please advise urgently,
